The government is introducing changes to the taxation of discretionary trusts.

A 30 per cent minimum tax will apply from 1 July 2028.

These changes aim to make the tax system fairer and more sustainable.

Feedback

We are seeking feedback on key aspects of the proposed changes, including:

  • expanded rollover relief to support restructuring

  • how excess franking credits should be treated

  • ways to collect the minimum tax.

Background

The government announced this minimum tax in the 2026-27 Budget.

It will apply to certain discretionary trusts from 1 July 2028.

It will not apply to other types of trusts. Some types of income are also excluded.

Trusts who choose to restructure can access expanded rollover relief for 3 years from 1 July 2027.
