This paper seeks views on options to strengthen the Unit Pricing Code.
We seek feedback on options to:
expand the scope of retailers covered
improve display requirements
make unit pricing measurements and cross‑retailer price comparisons more consistent
address shrinkflation
introduce civil penalties for supermarkets that breach the Code.
Background
The Unit Pricing Code is a mandatory industry code of conduct. It was made under Part IVB of the Competition and Consumer Act 2010.
It requires certain grocery retailers to use unit pricing when selling groceries to consumers. This makes it easier to compare prices. This helps shoppers make more informed purchases.
This paper builds on the government’s announcements about:
implementing Australian Competition and Consumer Commission recommendations to improve transparency on supermarket prices.
The original Code was made in 2009. It was remade without significant changes in 2021. Treasury consulted on the 2021 changes.
